Terms of Service

These terms govern your use of Kinvela, the AI-powered family management service operated at kinvela.com.

1. Description of Service

Kinvela is a family operating system that helps households manage schedules, events, home maintenance, and budgets through SMS, email, and a web dashboard. The platform leverages AI to interpret, arrange, and respond to user communications.

2. Account and Access

Each family account is managed by one or more admins (typically parents). These administrators control member addition, permissions, and information accuracy. Users must secure their account credentials.

3. Acceptable Use

You agree to use Kinvela only for lawful, personal family management purposes. Prohibited activities include spam, harassment, harmful content transmission, and unauthorized access to other families' information or security circumvention.

4. Not a Professional Service Provider

You acknowledge and agree that Kinvela is not a licensed contractor, home inspector, HVAC technician, plumber, electrician, financial advisor, insurance agent, attorney, or any other licensed professional. Kinvela is not a financial institution (as defined in the Gramm-Leach-Bliley Act, 15 U.S.C. §§ 6801 et seq.), consumer reporting agency (as defined in the Fair Credit Reporting Act, 15 U.S.C. § 1681a(d)), creditor, debt collector, loan servicer, investment advisor, insurance broker, or tax preparer. The Services are a household organizational tool, not a substitute for professional inspection, maintenance, financial planning, or legal advice.

5. Artificial Intelligence Limitations

Kinvela uses artificial intelligence to process, classify, and organize information you provide. You acknowledge and agree that:

  • AI-generated content may contain errors, omissions, inaccuracies, or misinterpretations;
  • AI may fail to identify, flag, or correctly classify time-sensitive, safety-critical, or financially consequential information;
  • AI may misinterpret the content, urgency, or intent of messages, emails, or other inputs;
  • You are solely responsible for reviewing and verifying any information processed, summarized, or acted upon by the AI; and
  • Kinvela makes no representation or warranty regarding the accuracy, completeness, reliability, or timeliness of any AI-generated output.

6. Home Maintenance Reminders

Kinvela may provide reminders, suggestions, or general guidance related to home maintenance schedules, including but not limited to HVAC filter replacement, sump pump maintenance, appliance servicing, and similar tasks. These reminders are based on general manufacturer recommendations and user-provided information, and are provided for informational convenience only. They do not constitute a professional home inspection, warranty, or guarantee regarding the condition, safety, or functionality of any appliance, system, or component in your home. You acknowledge that:

  • Home systems and appliances can fail at any time regardless of maintenance schedules;
  • Kinvela has no ability to physically inspect, monitor, or assess the actual condition of your home, appliances, or systems;
  • Manufacturer recommendations are general guidelines and may not account for your specific equipment age, condition, usage patterns, local climate, or installation quality;
  • You remain solely responsible for the maintenance, inspection, and safe operation of your home and all systems therein; and
  • Kinvela is not liable for any property damage, personal injury, or loss arising from the failure of any home system or appliance, whether or not a related reminder was provided, missed, delayed, or inaccurate.

7. Calendar, Scheduling, and Reminder Limitations

Kinvela provides calendar synchronization, scheduling, and reminder features as a convenience. You acknowledge that these features depend on third-party services (including but not limited to Google Calendar, Apple Calendar, and SMS/email delivery networks) and may experience delays, failures, or inaccuracies. Kinvela does not guarantee that any reminder, notification, or calendar entry will be delivered accurately, completely, or on time. You remain solely responsible for independently tracking and attending to your appointments, deadlines, obligations, and commitments. Kinvela shall not be liable for any consequence — including missed appointments, missed deadlines, late fees, penalties, expired offers, lapsed insurance, legal consequences, or any financial loss — resulting from a reminder or calendar update that was not delivered, was delivered late, was inaccurate, or was incomplete.

8. Financial Information

Kinvela may display, organize, or reference financial information such as bill due dates, subscription renewal dates, payment deadlines, or fee schedules. This information is provided for organizational convenience only and does not constitute financial, tax, legal, insurance, or accounting advice. You are solely responsible for verifying all financial obligations, due dates, and payment amounts independently. Kinvela shall not be liable for any late fees, penalties, interest charges, credit score impacts, service disconnections, or other financial consequences arising from reliance on information presented through the Services.

9. SMS Messaging Program

By providing your phone number and opting in during signup, you consent to receive SMS messages from Kinvela. Messages include responses to your texts, schedule notifications, event reminders, and optional proactive alerts (daily briefings, conflict warnings, deadline reminders). Message frequency varies based on your usage and notification settings.

You may opt out at any time by texting STOP to any Kinvela message. You will receive a confirmation and no further messages will be sent. For help or support, text HELP to any Kinvela message, or email support@kinvela.com.

By opting in, you also acknowledge our Privacy Policy regarding how your phone number and message data are handled.

10. Subscription and Payment

The service provides free and paid tiers. We reserve the right to change pricing with 30 days notice.

11. Data and Privacy

Your use of Kinvela is also governed by our Privacy Policy. You retain ownership of all data you provide to Kinvela. The platform does not sell user information.

12. No Guarantee of Availability

The Services are provided on an "as is" and "as available" basis. Kinvela does not warrant uninterrupted, timely, secure, or error-free operation. Service outages, maintenance windows, third-party API failures, network issues, or software bugs may prevent delivery of reminders, notifications, or calendar updates without notice.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Kinvela and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to property damage, personal injury, water damage, fire damage, missed deadlines, late fees, financial penalties, lost profits, or loss of data, arising out of or related to your use of or inability to use the Services, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if Kinvela has been advised of the possibility of such damages.

In no event shall Kinvela's total aggregate liability exceed the amount you paid to Kinvela in the twelve (12) months preceding the claim.

14. Your Responsibility

You agree that you will not rely on Kinvela as your sole or primary means of tracking safety-critical maintenance, medical appointments, legal deadlines, financial obligations, or any matter where failure to act could result in property damage, personal injury, financial loss, or legal consequences.

15. Termination

Users may cancel anytime. The company may suspend or terminate accounts violating these terms. Data export options exist post-termination.

16. Changes to These Terms

We may update these terms from time to time. Continued service use implies acceptance. Material updates trigger SMS or platform notifications.
